Can a Buyer Reclaim an RV Purchased in Good Faith?

In property law, disputes over ownership rights can be especially complex when a vehicle changes hands under suspicious circumstances. A German court decision sheds light on how the concept of good faith can affect a buyer’s rights in such cases.

In this particular instance, the defendant (B) rented out his RV to a man named V. Instead of returning the RV when the rental period ended, V decided to advertise it for sale. K, a used car dealer, came across the ad and contacted V. They agreed to meet, finalize the purchase, and inspect the vehicle. However, upon arriving at the meeting point, K was directed to a nearby parking lot where V handed over the RV and its documents, ostensibly showing B as the rightful owner. K paid €9,000 for the RV but later discovered that the vehicle's papers were forged. The RV was subsequently seized by the police and returned to B, prompting K to ask the court to order the vehicle returned to him.

Legal Focus: Ownership Transfer and Good Faith

At the heart of the case was whether K could claim ownership through good faith purchase under sections § 929 and § 932 of the German Civil Code (BGB). These laws allow for the transfer of property when there is mutual agreement and when the buyer acts in good faith, meaning they have no knowledge of any underlying deception or fraudulent conduct.

In this case, V’s impersonation of B complicated matters. Typically, if a party uses a false identity in a transaction, it would raise doubt about the sale's validity. However, the court noted that K’s primary focus was on the legitimacy of the vehicle's documents, not on V’s true identity. Since the documents appeared genuine, K had no immediate reason to question V's right to sell the RV.
